He was promoted Captain of the Company to date from 6 October 1862. After the consolidation between the 105th and 94th New York Infantry regiments in March 1863, he continued in service as a Captain in the 94th, He was captured at Gettysburg on 1 July 1863, and was a prisoner of war until paroled 18 April 1865.
